Tenant Obligations

For properties in England, the Tenant Fees Act 2019 means that in addition to rent, lettings agents can only charge tenants (or anyone acting on the tenant's behalf) the following permitted payments:

  • Holding deposits (a maximum of 1 week's rent);
  • Deposits (a maximum deposit of 5 weeks' rent for annual rent below £50,000, or 6 weeks' rent for annual rental of £50,000 and above);
  • Payments to change a tenancy agreement eg. change of sharer (capped at £50 or, if higher, any reasonable costs);
  • Payments associated with early termination of a tenancy (capped at the landlord's loss or the agent's reasonably incurred costs);
  • Exit Fee will be based on one calendar month multiplied by 10% + vat multiplied by number of full remaining months of the tenancy agreement. This will not be prorated on a daily calculation.
    Example:
    If you rent a property for £500.00 pcm and wish to leave the Property with 12 months remaining on the Fixed Term and as per tenancy, Tenant will have to give 2 Months' notice an amount equivalent to 4 months' commission, calculated as original commission paid (£500.00 x 10% = £50 + vat = £60.00) x 4 remaining full months = £240.00 Exit Fee.
  • Interest payments for the late payment of rent (up to 6% above Bank of England's annual percentage rate);
  • A charge of £25 to the Landlord's Agent for any payment presented to the Landlord's Agent's bank but returned, refused, or re-presented by the bank for any reason. This fee will be payable for each presentation which fails.
  • Reasonable costs for replacement of lost keys or other security devices;
  • Contractual damages in the event of the tenant's default of a tenancy agreement;
  • Any other permitted payments under the Tenant Fees Act 2019.
